<br />HRDU~ CE tl0 9'~~ 0 !_~=O 6 <br /> <br />ADOPTION OF AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 37-28 <br />THROUGH 37-30 AND 37-61 THEREOF PERTAINING TO LIABILITY INSURANCE <br />REQUIREMENTS FOR PUBLIC VEHICLES, INSPECTION REQUIREMENTS FOR <br />PUBLIC VEHICLES, AND OPERATION OF PUBLIC VEHICLES PROVIDING P ARA- <br />TRANSIT SERVICES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Sections 37-28, 37-29, 37-30, and 37-61 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 37-28. Liability Insurance. <br /> <br />No public vehicle shall be operated on the streets of the city unless the owner and driver <br />are protected at all times by liability insurance issued by a company authorized to do business in <br />the state in such amounts as are required by Section 46.2-2053 of the Code of Virginia. Both the <br />owner and the driver shall furnish proof deemed sufficient to the chief of police prior to the <br />issuance of any license, charter, certificate or permit required by the city code and at such times <br />and places as the chief of police may require and on an annual basis at the time of the renewal of <br />such insurance. <br /> <br />Sec. 37-29. General vehicle requirements. <br /> <br />(a) Public vehicles shall be ofthe enclosed or sedan type or station wagon with at <br />least four doors and not less than five-passenger capacity. <br /> <br />(b) Every public vehicle operated within the city shall meet all requirements of state <br />law and this Code and other ordinances of the city as to equipment and inspection. It shall be the <br />duty of the chief of police to make random inspections of public vehicles for compliance with <br />this subsection and report his findings to the city manager. Any random inspections so <br />conducted shall not take the place of annual orbi-annual required by Section 37-44(b) of this <br />chapter. <br /> <br />Sec. 37-30. Identification of taxicabs. <br /> <br />All taxicabs operating in the city under this chapter, except those being operated pursuant <br />to Section 37-61(b), shall have the word "taxicab" or "taxi" or "cab," the name of the owner, and <br />the number of the certificate of public convenience and necessity pursuant to which the taxicab is <br />operated plainly and permanently lettered thereon. <br /> <br />Sec. 37-61. Required. <br /> <br />It shall be unlawful to operate, or cause to be operated, within the city any public vehicle <br />unless: <br />
