<br /> <br />ORDINANCE TO CLOSE A PORTION OF A 15' WIDE ALLEY <br />EAST OF DOUGLAS AVENUE <br /> <br />WHEREAS, the City of Portsmouth has requested the closure of a portion of a 15' wide <br />alley east of Douglas Avenue, as hereafter described; and <br /> <br />WHEREAS, the Planning Commission, at a meeting held on December 6, 2011, <br />recommended approval of the closure and vacation of said 15' wide alley, described as follows: <br /> <br />The subject alley is located 140 feet, more or less, west of the southwest comer of <br />the intersection of Douglas A venue and Detroit Street. The proposed section to be <br />closed begins 120 feet south of the southern line of Detroit Avenue and continues <br />southwardly to its terminus. <br /> <br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that the subject portion of the 15' wide alley, be closed and vacated as a public street <br />and right of way all shown on Tax Plate 0176, a copy of which is attached hereto and made a <br />part hereof. <br /> <br />BE IT FURTHER ORDAINED that the City of Portsmouth reserves an ingress/egress <br />easement for use by the owners of Lots 1402, 1403, 1404, 1405, 1406 and 1407, as shown on the <br />plat entitled "Plat of Port Norfolk" recorded in the City of Chesapeake (formerly Norfolk <br />County) in Map Book 2, pages 90-91 and Map Book 4, pages 70-71, in the event that the land <br />encompassed by said lots is not included in a wetlands bank approved by the U. S. Army Corps <br />of Engineers and for the installation, operation, maintenance and replacement of public utilities. <br />Said easements may be released and vacated by the City Manager as he may in his discretion <br />deem appropriate and in the best interest of the City of Portsmouth. <br /> <br />BE IT FURTHER ORDAINED, that the City Manager is hereby authorized to execute <br />such deeds or other documents as he may deem appropriate and necessary to convey such rights <br />as the City may have in said closed street as may be required by the adjoining property owners. <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia at a meeting held on January <br />10,2012. <br /> <br />Teste: <br /> <br />City Clerk <br />
