<br /> <br />year for which an Enterprise Zone local incentive grant is payable, unless otherwise defined in an <br /> <br />incentive agreement. For the purposes of this Agreement, a tax year begins on the first day on which <br /> <br />the relevant property is assessed for the first time. <br /> <br />(e) Incentive Agreement means the agreement between the EDA and a Business Firm that <br /> <br />is a qualified recipient for an Enterprise Zone local incentive grant, which agreement governs the <br /> <br />terms and conditions under which the firm may receive and retain Enterprise Zone Local Incentive <br /> <br />Grants. Such agreements may provide for performance standards that exceed the minimums herein <br /> <br />established. For purposes of this section, the term Enterprise Zone local incentive grant includes the <br /> <br />provision of in-kind services through the Mixed-Use Development Incentive. With respect to the <br /> <br />Mixed-Use Development Incentive, the term Incentive Agreement may refer to a development <br /> <br />agreement or to a section( s) of a development agreement between the EDA and a Business Firm that <br /> <br />is a qualified recipient. <br /> <br />(f) Mixed-use Project means a project developed in accordance with the mixed-use <br /> <br />requirements and standards set out in the City of Portsmouth Zoning Ordinance. <br /> <br />(g) Net Increase, with respect to any tax, means the positive change ofthat tax occurring <br /> <br />during the Grant Period due to the assessment of a capital investment made by, or caused to be made <br /> <br />by, a qualified recipient and not by any change in the rate at which such capital investment is taxed, as <br /> <br />compared to the amount of that tax levied upon the qualified recipient during a period prior to the <br /> <br />Grant Period, as defined in the Incentive Agreement. <br /> <br />(h) New Positions means jobs of indefinite duration at a Business Firm located within an <br /> <br />Enterprise Zone requiring each employee to report for work within the Enterprise Zone and requiring <br /> <br />(1) a minimum of 35 hours of the employee's time per week for the entire normal year of the <br /> <br />Business Firm's operation, which "normal year" must consist of at least 48 weeks, (2) a minimum of <br />
