<br />R-ll-09 <br /> <br />A RESOLUTION AUTHORIZING CHANGE ORDERS IN EXCESS OF 25% TO THE <br />CONTRACT WITH THE ARMADA-HOFFLER CORPORATION FOR BUILDING <br />AND SITE WORK IMPROVEMENTS TO THE CHILDREN'S MUSEUM OF <br />VIRGINIA. <br /> <br />WHEREAS, in 2009, Armada-Hoffler Corporation submitted a successful bid of <br />$4,732,000 for the building and sitework improvements at the Children's Museum of Virginia; <br />and <br /> <br />WHEREAS, the building and site work contract portion of the project has experienced a <br />significant number of necessary but unforeseen changes due to underground utility, foundation <br />and structural conflicts as well as structural conflicts in tying the building addition to the existing <br />structure; and <br /> <br />WHEREAS, the cost of unforeseen changes will exceed the original contract amount by <br />more than 25% but will still remain with the original project budget; and <br /> <br />WHEREAS, the completion date for the project will be unaffected by the change orders; <br /> <br />and <br /> <br />WHEREAS, Section 12-183 of the City Code requires City Council approval to exceed <br />an original contract amount by more than 25% or $50,000, whichever is greater. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that, pursuant to Section 12-183 of the City Code, the City Manager and the City <br />Engineer are authorized enter into change orders in a total amount exceeding 25% of the original <br />contract amount and to expend the additional funds necessary to complete the project. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />March 8, 2011. <br /> <br />Teste: <br /> <br />City Clerk <br />
