<br />UP-I0-08 <br /> <br />16 Crawford Circle <br /> <br />All that certain piece or parcel of land situate in the City of <br />Portsmouth, Virginia, being a portion of the former railroad <br />right of way granted to the City of Portsmouth by CSX <br />Transportation, Inc., by deed dated September 13, 2000, <br />and duly recorded in Clerk's Office of the Circuit Court of <br />the City of Portsmouth, Virginia, in Deed Book 1311, at <br />page 122, being 37.50 feet in width and 467.00 feet more or <br />less and running from the east right of way line of <br />PortCentre Parkway eastwardly 467.00', more or less, as <br />measured along the centerline of the track located thereon <br />to the terminus of the track. <br /> <br />3. That the use permit is approved subject to the following conditions which shall be <br />observed by the applicants and any successor in interest: <br /> <br />(a) No more than six special events involving the service of food or drinks <br />shall be held in any calendar year as long as the Railroad Museum is <br />reliant on portable restroom facilities. Should the Museum install or <br />secure access to permanent rest rooms on site or nearby, the number of <br />events per calendar year shall no longer be limited, as deemed acceptable <br />to the Building Official. <br /> <br />(b) Prior to opening rail cars to the public, the cars shall be inspected and <br />certified to be free oflead, asbestos and any other air borne material(s) <br />hazardous to human health by a qualified independent inspector licensed <br />by the Commonwealth of Virginia. <br /> <br />(c) Amplified music or amplified entertainment is prohibited unless a separate <br />entertainment activity use permit has been issued by the City of <br />Portsmouth. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />January 25, 2011. <br /> <br />Teste: <br /> <br />City Clerk <br />
