<br />ORDIN <br /> <br />E NO ~2 O!'Q.::~~_, <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 22-3, BY <br />ADOPTING A NEW SECTION 22-564.1, AND BY REPEALING SECTION 22-471 <br />THROUGH 22-579 PERTAINING TO TRAFFIC INFRACTION PENALTIES, <br />AND THE BLOCKING OF INTERSECTIONS AND CROSSWALKS IN THE <br />CITY. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1, That Section 22-3 of the Code of the City of Portsmouth, Virginia (2006) <br />is amended and reordained to read as follows: <br /> <br />Sec. 22-.3. General penalty for violations of chapter. <br /> <br />(a) Unless otherwise provided, a violation of any of the provisions of this chapter <br />shall constitute a traffic infraction punishable by a fine of not more $250. <br /> <br />(b) Every person convicted of any state statute or city ordinance shall be <br />assessed the sum as set out in appendix A to this Code as part of the costs in each traffic <br />case in the district and circuit courts. The assessment shall be collected by the clerk of the <br />court in which the case is heard, remitted to the city treasurer, and held by the city <br />treasurer subject to appropriation to the sheriff for the funding of courthouse security <br />personnel. <br /> <br />2. That new Section 22-564.1 is adopted and added to Chapter 22 of the <br />Code of the City of Portsmouth, Virginia (2006) to read as follows: <br /> <br />Sec. 22-564.1. Blocking intersections or marked crosswalks. <br /> <br />(a) No operator of a vehicle shall enter an intersection or a marked crosswalk, <br />unless there is sufficient space beyond such intersection or crosswalk, in the direction in <br />which such vehicle is proceeding, to accommodate the vehicle without obstructing the <br />passage of other vehicles or pedestrians, notwithstanding any traffic-control signal <br />indication to proceed. <br /> <br />(b) Any violation of this section shall be punishable by a fine of $250. <br /> <br />3. That Sections 22-471 through 22-509 of the Code of the City of <br />Portsmouth, Virginia (2006) are repealed. <br /> <br />4. That this ordinance shall take effect on the date of its adoption. <br />
