<br />Sec. 33.1-4. Authority. <br /> <br />The Planning Commission and the Planning Director have been established and created pursuant <br />to the provisions of chapter 2 and chapter 40 of this Code. Pursuant to the expressed provisions of <br />said chapters, and in accordance with the specific provisions of this chapter, the Planning <br />Commission, the Planning Director and the City Engineer shall have the powers and duties <br />necessary to carry out the functions assigned to them under this chapter and the Code of Virginia. <br /> <br />Sec. 33.1-5. Violations and Penalties. <br /> <br />(a) Any person, firm or corporation, whether as principal, Agent, employee or otherwise, <br />violating the provisions of this chapter shall be subject to a fine of not more than $500.00 for <br />each lot or parcel of land so subdivided or transferred or sold. The description of such lot or <br />parcel by metes and bounds in the instrument of transfer or other document used in the <br />process of selling or transferring shall not exempt any transaction from such penalties or from <br />other remedies. Each and every day any violation of this chapter shall continue shall, except <br />as otherwise provided, constitute a separate offense. <br /> <br />(b) Any of the following shall be a violation of this chapter and shall be subject to the <br />enforcement remedies and penalties provided by this chapter and by state law: <br /> <br />(1) To subdivide land without any and all necessary approvals under this chapter. For <br />purposes of this chapter, subdividing land shall include any efforts to subdivide land, <br />however preliminary, including, but not limited to, selling or offering to sell part of such <br />land; <br /> <br />(2) To engage in any development, use, construction or other activity of any nature in any <br />way inconsistent with any subdivision plat, variance or other action approved under this <br />chapter; <br /> <br />(3) To violate, by act or omission, any term, condition or qualification placed by the city <br />upon a required subdivision plat or other approval under this chapter; <br /> <br />(4) To erect, construct, reconstruct, alter, maintain or use any building or structure or to use <br />any land in violation or contravention of any zoning, subdivision or general regulation of this <br />chapter or any amendment thereto; <br /> <br />(5) To continue any of the above stated violations. <br /> <br />Sec. 33.1-6. Administration and enforcement of chapter. <br /> <br />The Agent is hereby delegated to administer and enforce the provisions of this chapter. The Agent <br />shall be considered the Agent of the governing body. Notwithstanding an appeal as provided for <br />in section 33.1-9, approval or disapproval by the Agent shall constitute approval or disapproval as <br />though it were given by the governing body. The Agent may consult with the commission on <br />matters contained herein and may call for written opinions or decisions from other city <br />departments, the transportation department, and the health department in considering details of <br />any submitted plat. <br /> <br />Page 2 of33 <br />
