<br />[\RUDt.llt.~,,~~~c.~~<< <br /> <br />AN ORDINANCE APPROPRIATING $4,000,000 IN THE FY 2010-2011 CITY GARAGE <br />FUND FROM ITS FUND BALANCE TO PROVIDE FUNDS FOR THE PURCHASE OF <br />VEHICLES AND DECLARING THE INTENT OF THE CITY TO REIMBURSE ITSELF <br />FROM THE PROCEEDS OF OBLIGATIONS OF THE CITY. <br /> <br />WHEREAS, in the second half of fiscal year 2008, the administration (the <br /> <br />"Administration") of the City of Portsmouth, Virginia (the "City"), determined to slow down the <br /> <br />purchase of vehicles and apparatus in an effort to reduce the corresponding debt/lease payments <br /> <br />that would be associated with said purchases, and the then five-year Fleet Replacement Plan was <br /> <br />put on hold to ensure the City's ability to repay the debt while staying within its financial policy <br /> <br />limits; <br /> <br />WHEREAS, in the two years since the Fleet Replacement Plan was put on hold, the fleet <br /> <br />continued to receive wear and tear, and many of the vehicles have been used well beyond their <br /> <br />normal useful life; and <br /> <br />WHEREAS, as part of prudent fiscal management, the City needs to purchase several <br /> <br />replacement pieces of fire apparatus, police vehicles, and waste management vehicles, among <br /> <br />others, (collectively, the "Vehicles"), as the condition of several vehicles, particularly public <br /> <br />safety vehicles, has reached a counterproductive level for the service delivery required. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br /> <br />CITY OF PORTSMOUTH, VIRGINIA: <br /> <br />1. That the amount of $4,000,000 from the fund balance of the fiscal year 2010-2011 <br /> <br />City Garage Fund is appropriated for the acquisition of the Vehicles or any portion thereof. <br /> <br />Should the amount appropriated exceed that which is necessary to acquire the Vehicles or any <br /> <br />portion thereof so acquired, the appropriation is hereby reduced accordingly. <br /> <br />2. That the City Manager, the Chief Financial Officer, and such other members of <br /> <br />the Administration as may be designated by the City Manager or the Chief Financial Officer are <br />
