<br />'if <br /> <br />OROI... 2010-?~ <br /> <br />AN ORDINANCE DESIGNATING LEXINGTON DRIVE, DALE DRIVE, MERRIMAC <br />DRIVE AND BUCHANAN AVENUE AS HIGHWAYS FOR PURPOSES OF LAW <br />ENFORCEMENT. <br /> <br />WHEREAS, by Ordinances No. 2009-53 and 2009-54, the Council ofthe City of <br />Portsmouth, Virginia did close and vacate portions of Lexington Drive and Dale Drive as public <br />streets, and <br /> <br />WHEREAS, when title to said streets thereafter vested in Portsmouth Redevelopment <br />and Housing Authority by operation of law, they became private streets, and <br /> <br />WHEREAS, Merrimac Drive and Buchanan Avenue are private streets within Swanson <br />Homes, and <br /> <br />WHEREAS, Section 46.2-1307 of the Code of Virginia provides that the governing <br />body of a City may designate private roads as highways for law enforcement purposes within <br />any residential development containing 100 or more residential dwelling units, and <br /> <br />WHEREAS, the aforementioned streets serve a residential development having 100 or <br />more residential dwelling units, and <br /> <br />WHEREAS, Portsmouth Redevelopment and Housing Authority desires that the said <br />streets be designated by Council of the City of Portsmouth as highways for law enforcement <br />purposes, as follows: <br /> <br />Lexington Drive - All that certain area commencing at the west line of Columbus A venue across <br />from Tax Map & Parcel 0139-0750 and thence running northwesterly, southeasterly and <br />northeasterly in a generally trapezoidal shape through the Lincoln Park community and <br />terminating at the west line of Columbus Street across from Tax Map and Parcel 0139-0700. <br /> <br />Dale Drive - All that certain area commencing at the west line of Columbus Avenue across from <br />Lincoln Street and thence running westerly, southerly and easterly in a horseshoe shape through <br />the Dale Homes community and terminating at the west line of Columbus Street across from <br />Jefferson Street. <br /> <br />Merrimac Drive-All that area beginning at the eastern intersection of Merrimac Drive with <br />Lansing A venue and going in a westerly direction and curving south and ending at its <br />intersection with the northern line of Swanson Parkway. <br /> <br />Buchanan Avenue - All that area beginning at the intersection of Buchanan Avenue with the <br />southern line of Merrimac Drive and continuing in a southerly direction and ending at the <br />northern side of South Street. <br /> <br />NOW THEREFORE BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />----1 <br />
