AN ORDINANCE TO CLOSE SWANSON P ARKW A Y IN SWANSON HOMES WHEREAS, the Portsmouth Redevelopment and Housing Authority has requested the closure of Swanson Parkway in Swanson Homes, as hereafter described; and WHEREAS, the Planning Commission at a meeting held on July 6, 2010, recommended approval of the closure and vacation of Swanson Parkway in Swanson Homes, and described as follows: Swanson Parkway - All that certain area commencing on the west line of Lansing A venue and thence running westerly and southerly curving through the Swanson Homes community and terminating at the northern line of South Street which runs along the northern boundary of 1-264, as shown on Tax Plate 0115, a copy of which is attached hereto. WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. WHEREAS, the aforesaid Swanson Parkway is hereby designated as a highway for law enforcement purposes in accordance with Virginia Code Section 46.2-1307. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that Swanson Parkway in Swanson Homes, be closed and vacated as a public street and right of way commencing on the west line of Lansing Avenue and running westerly and southerly curving through the Swanson Homes Community and terminating at the northern line of South Street, which runs along the northern boundary of 1-264, all shown on Tax Plate 0115, a copy of which is attached hereto and made a part hereof. BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an easement in Swanson Parkway hereby closed and vacated for the installation, operation, maintenance and replacement of public utilities which said easements may be released and vacated by the City Manager of the City of Portsmouth as he may in his discretion deem appropriate and in the best interest of the City of Portsmouth. BE IT FURTHER ORDAINED that the City Manager is hereby authorized to execute such deeds or other documents as he may deem appropriate and necessary to convey such rights as the City may have in said closed street as may be required by the adjoining property owners.
