<br />ORDIIAIIE 10.2 0 1 0 - 51_-" <br /> <br />AN ORDINANCE TO AMEND CHAPTER 7 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 7-2 THEREOF <br />PERTAINING TO THE REQUIREMENT OF A CONTRACTOR'S <br />REGISTRATION AND BOND. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Section 7-2 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended and reordained to read as follows': <br /> <br />Sec. 7-2. Contractor's registration and bond. <br /> <br />(a) It shall be the duty of every building, electrical, mechanical or plumbing <br />contractor who makes contracts for work for which a permit is required, and every <br />contractor or subcontractor making such contracts and subletting the same or any part <br />thereof, to register, with the building official, giving his full name and the addresses of <br />his residence and place of business. In case of a change in either such address, he shall <br />have a corresponding change made in such register. It shall be the further duty of every <br />such contractor or subcontractor not licensed by the Virginia Department of Professional <br />and Occupational Regulation to give good and sufficient bond, in the sum of $5,000.00, <br />to be approved by the department oflaw ofthe city, payable to the city with surety <br />conditioned to indemnify and save harmless the city as well as any other person from all <br />expense'and damage that may be caused by any negligent, defective or inadequate work <br />done in the city under his certificate, license or direction and to secure the payment of all <br />required fees and to secure and ensure his compliance with the regulations of the building <br />official and the building code and other ordinances or laws of the city. <br /> <br />(b) When any work done by a contractor or subcontractor not licensed by the <br />Virginia Department of Professional and Occupational Regulation is deemed defective or <br />inadequate by the inspector from the building inspection division of the department of <br />permits and inspections and the contractor or subcontractor fails to revise or put such <br />work in proper condition to the satisfaction of the inspector within ten days after written <br />notification to do so sent to the address shown in the register provided for in subsection <br />(a) of this section, the bond posted pursuant to subsection (a) of this section shall be <br />forfeited and the principal and surety thereon shall be and become liable for and shall pay <br />so much on account of such bond as may be necessary in order to perfect such work and, <br />in addition thereto, shall pay any and all damages which may be occasioned to any person <br />by reason of such defective or inadequate work. <br /> <br />2. That this Ordinance shall take effect on July 1,2010. <br />
