<br />(e) The applicant shall maintain the existing 4-foot grey chain link fence <br />around the outdoor play area. Any new fencing shall be a 4-foot black <br />vinyl coated chain link fence. The fencing shall not contain opaque slats. <br /> <br />(f) The existing tree line along the northeastern boundary of the property shall <br />be maintained. An opaque vegetative screen shall be established along the <br />southern boundary of the parking area facing Portsmouth Boulevard. The <br />screen shall consist of shrubs that are a minimum of 36" in height <br />alternating with 2 yz" caliper canopy trees that are a maximum of 8 feet in <br />height. An alternative plan may be submitted for review and approval by <br />the Planning Director. The approved landscaped buffer shall be installed <br />prior to the issuance of a certificate of occupancy. <br /> <br />(g) Proposed signage shall comply with Section 40.1-5.11(H)(4) - Sign, <br />Institutional Freestanding and shall be reviewed and approved by the <br />Zoning Administrator. <br /> <br />(h) The facility shall be operated in compliance with applicable codes, <br />ordinances and regulations of federal, state and local government and all <br />required licenses and permits shall be obtained and remain in effect during <br />the operation of the facility. <br /> <br />(i) All taxes or fees associated with the operation shall be paid when due. <br /> <br />(j) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and <br />maintain in effect all necessary licenses and permits. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />September 28,2010. <br /> <br />Teste: <br /> <br />City Clerk <br />
