<br />4, When operating independently, the City of Portsmouth agrees to notify <br />the COTP Hampton Roads or his or her designee, of any suspicious <br />activity or safety or security zone violations as soon as practicable. <br /> <br />C, USE OF FORCE <br /> <br />1, Nothing in this agreement impairs the inherent right of self-defense by <br />law enforcement personnel of either the USCG or the City of Portsmouth. <br />Except as provided in paragraphs 3 and 4, below, nothing in this <br />agreement shall act to limit or restrict the City of Portsmouth from <br />employing legally authorized use of force. <br /> <br />2. All USCG personnel shall, at all times, follow the USCG use of force <br />policy as most recently specified through applicable Commandant <br />Instructions and manuals, and as may be further defined by District <br />Commanders or higher authority. <br /> <br />3, In joint operations between the USCG and the City of Portsmouth for <br />the enforcement of safety or security zones where law enforcement <br />personnel are onboard USCG platforms, the USCG use of force policy <br />shall apply at all times, USCG law enforcement personnel shall comply <br />with the USCG use of force policy while deployed onboard City of <br />Portsmouth platforms, <br /> <br />4, The City of Portsmouth may engage in patrols and enforcement <br />assistance relative to a federal safety or security zone, without the <br />supervision of the Coast Guard, by operating independently aboard their <br />own marine police platforms, in accordance with the provisions stated <br />herein. However, before undertaking enforcement assistance <br />independently and without the supervision of the Coast Guard, the City of <br />Portsmouth must submit documentation, regarding their use of force <br />policy, to the Commander of the Fifth Coast Guard District for review, <br />The Commander of the Fifth Coast Guard District will review this <br />documentation to ensure that the application of the City of Portsmouth use <br />of force policy, in the context of this agreement, will not conflict with <br />policy guidance set forth in the Coast Guard's Maritime Law Enforcement <br />Manual (COMDTINST M16247.1D). In joint operations, USCG and law <br />enforcement personnel shall meet to clarify and agree upon the use of <br />force policy under which each agency is operating. Except as described <br />above, when using force for any reason other than enforcement assistance, <br />in support of a safety or security zone, the City of Portsmouth use of force <br />policies shall apply. <br /> <br />5. Law enforcement personnel exercising authority under this agreement, <br />other than verbal warnings, shall submit written documentation of any <br />action taken pursuant to this agreement to the COTP Hampton Roads, <br />Such documentation shall include, but shall not be limited to, case <br />investigation reports, a copy of any written warning or documentation of <br /> <br />5 <br />
