<br />B, ENFORCEMENT ASSISTANCE: Enforcement assistance is any activity <br />relating to the enforcement of Federal law that does not amount to enforcement <br />action, but which is helpful to the Coast Guard in furthering the purposes of an <br />established safety or security zone. When authorized by COTP Hampton Roads <br />or his or her designated Coast Guard representative, this agreement, or relevant <br />operation order, law enforcement officers may be present within a designated <br />safety or security zone created by the Coast Guard, While present, such law <br />enforcement officers are authorized to monitor activities within such zones, detect <br />and report potential violations of federal law to the Coast Guard and reasonably <br />detain individuals, when necessary, While patrolling, law enforcement officers <br />are authorized to approach, intercept and hail other vessels within the zone, so <br />long as such activities are lawful under the law of the Commonwealth of Virginia. <br /> <br />V, LEGAL AUTHORITIES: <br /> <br />A. U S, Coast Guard, COTP Hampton Roads, the Fifth District Commander, <br />and the Atlantic Area Commander are authorized to create and enforce limited <br />access zones for the security and protection of maritime assets, both afloat and <br />ashore, within the waters of Virginia that are subject to federal jurisdiction, <br /> <br />I, A safety zone, according to 33 C,F,R. ~ 165,20, is "a water area, shore <br />area, or water and shore area to which, for safety or environmental <br />purposes, access is limited to authorized persons, vehicles, or vessels, It <br />may be stationary and described by fixed limits or it may be described as a <br />zone around a vessel in 1110tion. " The Coast Guard's authority to issue a <br />regulation creating a safety. zone arises under Title I of The Ports and <br />Waterways Safety Act (P"WSA). See, 33 US,C, ~ 1231, These zones are <br />established when neces~ary for the protection of any vessel, structure, <br />waters, or shore area from a safety or environmental hazard, <br /> <br />2, A security zone, according to 33 C.F,R. ~ 6,01-5, is "all areas of land, <br />water, or land and water, which are so designated by the Captain of the <br />Portlor such time as he (!.eems necessary to prevent damage or injury to <br />any vessel or waterfrontfac;ility, to safeguard ports, harbors, territories, <br />or waters of the United EJrates or to secure the observance of the rights <br />and obligations of the Uf!:ited States," The Coast Guard's authority to <br />issue a regulation creating a security zone arises under the Magnuson Act <br />and also arises under TItle I of The Ports and Waterways Safety Act <br />(PWSA), See 50 U.S.c., ~191 and 33 US.c. ~ 1231 respectively. <br />Security zones are used for national security interests rather than strictly <br />for safety considerations, <br /> <br />3, The parties agree that the existence of a Coast Guard safety or security <br />zone does not in any way foreclose other legitimate, law enforcement <br />activities of City of Portsmouth law enforcement personnel or actions <br />within or in the vicinity of such safety or security zone, <br /> <br />2 <br />
