A nominating petition shall conform substantially to the <br />following requirements: <br /> <br />(1) Such petition shall state the name and place of residence of each person whose name is presentedfor a place upon the <br />ballot, and shall request such person or persons to become a candidate or candidates for the office of Mayor or City Council. <br /> <br />(2) Such petition shall be signed by at least one hundred and twenty-five (125) qualified electors of the city and shall contain <br />the residence address of each elector and an affidavit of any other qualified voter who witnessed said signatures. <br /> <br />(3) Each elector signing a petition may subscribe to one nomination for each of the places to be filled at the ensuing election, <br />and no more. <br /> <br />(4) Such petition shall not be signed by any elector prior to the first Tuesday in January of the year of such election, and such <br />petition shall be filed with the general registrar of the city not later than the time fixed for the closing of the polls on the first <br />Tuesday in June of the year of the election. <br /> <br />b. Any person whose name has been submitted for candidacy by petition as herein provided, shall file his or her acceptance of <br />such candidacy with the general registrar of the city not later than the time fixed for the closing of the polls on the first Tuesday <br />in June of the year of the election, otherwise that name shall not appear on the ballot. The filing of such acceptance shall be <br />deemed equivalent to the filing of notice of candidacy under the general election laws of the State, and no other notice of <br />candidacy need be given by the person filing the same. <br /> <br />c. No person may be a candidate for the office of Mayor and office of City Council member in the same election. <br /> <br />d. Candidates for the offices of Mayor and City Council member shall appoint one campaign treasurer and file the name and <br />address of said campaign treasurer with the Portsmouth Electoral Board not later than the first Tuesday of June of the year of <br />the election. Any candidate who fails to appoint and report the appointment of a treasurer shall be deemed to have appointed <br />him/herself treasurer. All candidates for such offices shall comply with the applicable provisions of Chapter 9 of Title 24.2 of <br />the Code of Virginia. <br /> <br /> <br />93.03. Election of Mayor and City Council Members. <br /> <br />a. On the first Tuesday in May in nineteen hundred seventy-four, and on the first Tuesday in May of every fourth year <br />thereafter, there shall be a general election at which time the qualified voters of the city shall elect three City Council members <br />for terms of four years. On the first Tuesday in May nineteen hundred seventy-six, and on the first Tuesday in May of every <br />fourth year thereafter, there shall be a general election at which the qualified voters of the city shall elect a Mayor and three <br />Council members for terms of four years. All terms shall begin on the first day of July next following the date of their election. <br /> <br />However, beginning in 2012, the municipal election shall be held at the time of the November general election with terms to <br />commence on January 1. No term ofa Mayor or member of Council elected in 2008 or 2010 shall be shortened in <br />implementing the change to the November election date. The Mayor and members of Council who were elected at a May <br />general election and whose terms are to expire as of June 30 shall continue in office until their successors have been elected at <br />the November general election and have been qualified to serve. <br /> <br />b. The candidates at any municipal election for the election of City Council members, equal in number to the places to be filled, <br />who receive the largest number of votes cast at such election shall be declared elected to the office of City Council. The <br />candidate for Mayor who receives the largest number of votes at any municipal election shall be declared elected to the office <br />of Mayor. <br /> <br />c.In the event any member of City Council during his or her tenure of office shall desire to be a candidate for the office of <br />Mayor, he or she shall be eligible to do so, but shall tender resignation as a member of City Council not fewer than ten days <br />prior to the final date for the filing of petitions and notices of acceptance as specified herein, such resignation to be effective on <br />December 31st of the election year. Such resignation shall state the council member's intention to run for the office of Mayor <br />and shall require no formal acceptance by the remaining members of City Council and shall be final and irrevocable as of the <br />date it is tendered. <br /> <br />d.
