That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The interior occupant load of the first floor shall be limited to 154 people. The exterior occupant load of the first floor shall be limited to 36 people. The occupant load of the second floor shall be limited to 345 people. The occupant load of the third floor shall be limited to 226 people. The occupant load of the entire building shall; therefore, be limited to a total of 761 people, including employees, or the capacity set by the Building Official. The more restrictive of the two capacity limitations shall apply. The occupancy load shall not be exceeded at any time. (b) The hours of operation shall be limited to the hours between 8 :00 a.m. and 2:00 a.m. (c) Hours of entertainment shall be limited to the hours between 11: 00 a.m. and 2:00 a.m. (d) The site layout plan shall generally be in accordance with the floor plans dated October 2,2008 and November 11,2008. Minor changes may be approved by the Director of Planning. (e) Rear doors shall be used for emergency exits only and shall not be propped open during the hours of operation. (f) The applicant shall obtain approval from the Downtown Design Committee (DDC) for any exterior alterations, including signage. (g) Valet parking, if provided, shall be in an off-street public parking lot or deck. (h) Sufficient interior security shall be provided by individuals who are certified in law enforcement by the Virginia Department of Criminal Justice Services. Exterior security shall be provided, as needed, by off-duty law enforcement personnel. (i) Noise from the entertainment establishment shall comply with City Code Section Sec. 24-255. Loud disturbances and unnecessary noise or sound.
