<br />3. That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 75 persons, including <br />staff and patrons, at any time as required by the Building Official. <br /> <br />(b) The hours of operation shall be no earlier than 8:00 a.m. to no later than <br />10:00 p.m. <br /> <br />(c) The required eighteen (18) parking spaces for the business shall be <br />provided for in the shared parking area of the shopping center. <br /> <br />(d) The applicant shall obtain and retain all appropriate permits and licenses <br />for the establishment. <br /> <br />(e) The proposed business shall operate in accordance with federal, state and <br />local regulations. <br /> <br />(f) The applicant shall be required to install a backflow preventer, if <br />determined necessary by the Department of Public Utilities. <br /> <br />(g) All taxes in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />September 22,2009. <br /> <br />Teste: <br /> <br />City Clerk <br />
