<br />40'::1::. to a point; thence, in a southerly direction 115'::1::. to a <br />point; thence, in an easterly direction 40'::1::. to a point; <br />thence, in a northerly direction 115'::1::. to a point of the <br />beginning. <br /> <br />3. That the use permit for an entertainment establishment is approved subject <br />to the following conditions which shall be observed by the applicant and any successor in <br />interest: <br /> <br />(a) The occupant load of the facility shall not exceed 130 persons, including <br />staff and patrons, at any time as required by the Building Official. <br /> <br />(b) The hours of operation shall be no earlier than 8:00 a.m. to no later than <br />2:00 a.m. <br /> <br />(c) The hours of entertainment shall be no earlier than 11 :00 a.m. to no later <br />than 2:00 a.m. <br /> <br />(d) Sufficient interior and exterior security shall be provided by individuals <br />who are certified by the Virginia Department of Criminal Justice Services. <br /> <br />(e) The site layout plan shall generally be in accordance with the floor plan <br />dated 6/5/09. Minor changes may be approved by the Director of <br />Planning. <br /> <br />(f) Rear doors shall be used for emergency exits only and shall not be <br />propped open during hours of operation. <br /> <br />(g) The applicant shall obtain approval from the Downtown Design <br />Committee (DDC) for any exterior alterations, including signage. <br /> <br />(h) Noise from the establishment shall comply with City Code Section 24-255 <br />- Loud disturbances and unnecessary noise or sound. <br /> <br />(i) The applicant shall be required to install a backflow preventer, if <br />determined necessary by the Department of Public Utilities. <br /> <br />G) The applicant must obtain and keep current any required operating <br />licenses and shall operate in accordance with federal, state and local <br />regulations. <br /> <br />(k) All taxes and fees in connection with the proposed use shall be paid when <br />due. <br />
