<br />4.1.1 Schematic Design Documents Phase. Within seven days of the Effective Date, <br />Seller's architect shall present to the City and to Court Officials preliminary Schematic <br />Design Documents for the new Courthouse in reasonably sufficient detail to show site <br />plan and floor plan layout, general appearance, and function to determine that the <br />Preliminary Schematic Design is appropriate for further development. Within thirty days <br />of the presentation of the Preliminary Schematic Design, the Seller's architect shall <br />present and deliver to the City and to Court Officials Schematic Design Documents for <br />the new Courthouse in reasonably sufficient detail to show site plan and floor plan layout, <br />general appearance, and function. During the thirty day Schematic Design period, the <br />Seller's architect will meet with the City and Court Officials to gather additional <br />information and input necessary for completion of the Schematic Design Documents. <br />The City shall consult with the Court Officials before granting approval. The City shall <br />have fifteen days from receipt within which to approve these documents and resolve any <br />issues arising therefrom. If approval is not received in writing by Seller and any issues <br />not resolved within said time period, then such time period may be extended by mutual <br />agreement for an additional period of time until the outstanding issues are resolved and <br />approval received. <br /> <br />4.1.2. Design Development Documents Phase. Within ninety days of the date the <br />Schematic Design Documents are finally approved by the City, Seller's architect shall <br />present and deliver to the City and to the Court Officials Design Development Documents <br />for the new Courthouse based on the approved Schematic Design Documents. During the <br />ninety-day Design Development period, the Seller's architect will meet with the City and <br />the Court Officials to gather additional information and input necessary for completion of <br />the Design Development Documents. The Design Development Documents shall define <br />the design of the Courthouse in further detail, including without limitation more detailed <br />floor plans and site plans; typical building sections, elevations, and construction details; <br />and equipment layouts. They shall include outline specifications that identify major <br />materials and systems and establish their level of quality. The City shall consult with the <br />Court Officials before granting approval. The City shall have fifteen days from receipt <br />within which to approve the Design Development Documents and resolve any issues <br />arising therefrom. If approval is not received in writing by Seller and any issues not <br />resolved within said time period, then such time period may be extended by mutual <br />agreement for an additional period of time until the outstanding issues are resolved and <br />approval received. If the City requests changes to the Design Development Documents <br />that are inconsistent with the previously approved Schematic Design Documents, Seller <br />shall have the right to treat this request as a change order. <br /> <br />4.1.3 Construction Documents Phase. Within 180 days of the date the Design <br />Development Documents are finally approved by the City, Seller will complete <br />Construction Documents in sufficient detail to qualify for issuance of a building permit <br />and submit them to the City and to the Court Officials for review. The Seller's Architect <br />will submit 100% Site Plan Construction Documents for the Site Plan permit review and <br /> <br />-8- <br /> <br />Draft #4. 1 <br />
