<br />1.9 Court Officials. The responsible officials of the Portsmouth court system. These <br />officials shall include the Chief Judge of Portsmouth Circuit Court, the Chief Judge of <br />Portsmouth General District Court, the Chief Judge of Portsmouth Juvenile and Domestic <br />Relations District Court, and the Clerks of said three courts (or their designees). <br />Generally, the Chief Judge of each of the three courts shall be authorized to speak to the <br />needs of that court with regard to the design and construction of the new courthouse, and <br />the Chief Judge of Circuit Court will have overall authority to comment on design and <br />construction. From time to time, there may be other court officials whose input is <br />appropriate and will be sought, including without limitation the Court Services Unit and <br />the Sheriff s Office. <br /> <br />1.10 Deed of Trust. A deed of trust to be placed on City Hall and the City Hall parking <br />deck on the date of the Initial Payment, as per Section 3.4.1 to secure payment of the <br />unpaid balance of the Total Courthouse Cost to Seller, as per Article VIII. <br /> <br />1.11 Design and Construction Documents. A term that includes the three separate sets <br />of documents to be prepared by Seller, acting through Seller's Architect: the Schematic <br />Design Documents, the Design Development Documents, and the Construction <br />Documents, each set of documents having progressively more detail than the prior set of <br />documents, as per Article IV. <br /> <br />1.12 Design Development Documents. The second of three sets of documents to be <br />prepared by Seller, acting through Seller's Architect, to be completed within ninety days <br />of the City's final approval of the Schematic Design Documents. <br /> <br />1.13 Development Fee. The fee to be paid by the City to the Seller for modifying, <br />adapting, and expanding the Building for use as a courthouse, as per Article III. <br /> <br />1.14 Development Work. The work of the Seller in modifying, adapting, and enlarging <br />the Building on the Property so that it may be used for a Circuit Court, a General District <br />Court, and a Juvenile and Domestic Relations Court, together with the Clerk's Offices for <br />those courts, as per Recital B. <br /> <br />1.15 Effective Date. This agreement shall become effective upon entry of an Order in <br />the Court Case that calls for construction of the Courthouse in a manner consistent with <br />this Agreement. The date of the Order shall be known as the "Effective Date." <br /> <br />1.16 Final Development Fee. The fee for the Development Work, to be disclosed <br />within three business days of approval of the Construction Plans. The Final Development <br />Fee shall not exceed $60,226,683, determined as per Article IV. <br /> <br />1.17 Improvements.
