<br />iI' <br /> <br />(i) The tower shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state and local governments. <br /> <br />G) Taxes and fees associated with the applicant's property shall be paid when <br />due. <br /> <br />(k) In the event that the tower is unused or becomes obsolete, it must be <br />removed within twelve months from the date that use ceases. <br /> <br />(1) Applicant and any subsequent tower operator shall maintain insurance <br />with respect to its development and use of the property for the proposed <br />wireless communications tower, as required by its agreements with the <br />property owner and Dominion Power. <br /> <br />(m) Lighting for the tower compound will be directed in such a way as not to <br />impact neighboring residents' quality of life. <br /> <br />(n) The noise and odor produced by the site shall not adversely impact <br />neighboring property owners. <br /> <br />(0) Only one tower shall be built on the site known as 3797 Lilac Drive under <br />this use permit. No antennas other than those of the applicant shall be <br />installed on the tower. <br /> <br />(p) After construction is complete, except in an emergency or because of <br />equipment failure, access to the equipment by applicant will be limited to <br />once every six months. <br /> <br />(q) After construction is complete, access to the applicant's equipment by <br />applicant will be through shared use of the existing driveway, as depicted <br />on the site plan. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held <br />on August 25, 2009. <br /> <br />Teste: <br /> <br />City Clerk <br />
