<br /> <br />reasonable and actual attorneys' fees, consultants' fees, court costs, expert witness fees, <br /> <br />assessment costs, cleanup costs and monitoring costs) arising out of or resulting from the <br /> <br />Railroad Museum's violation of this Section 7, including the Railroad Museum's disturbance, <br /> <br />excavation, treatment, handling, management, transportation, arrangement for disposal or <br /> <br />disposal in, on, under or from the Property of any hazardous waste, hazardous substances, <br /> <br />hazardous materials, toxic substances, solid waste, petroleum products, pollutants, contaminants <br /> <br />or similar materials as defined under any applicable environmental law, rule, regulation or <br /> <br />ordinance. This Section 7 shall survive termination of this Lease. <br /> <br />8. Railroad Tracks. Because the Property will revert to a prior owner if the railroad <br /> <br />tracks are ever removed, the Railroad Museum will not under any circumstances remove them. <br /> <br />The Railroad Museum understands and acknowledges that the City cannot guarantee or assure <br /> <br />the continued existence of rail tracks leading to the property, because that will ultimately be the <br />decision ofCSX Railway. <br />9. Condition of Property after Termination. <br />(A) If this lease should ever terminate, the parties shall meet and confer to discuss the <br /> <br /> <br />Property, with the goal of having the City continue indefinitely the operation of the physical <br /> <br /> <br />facilities and mission of Railroad Museum, if at all feasible. If the parties agree on such a course <br /> <br /> <br />of action, then (1) the Railroad Museum shall convey to the City ownership of the railroad cars <br /> <br /> <br />and related other personalty on the Property, and (2) the City shall erect a permanent plaque or <br /> <br /> <br />monument giving appropriate credit to those individuals and organizations who created and <br /> <br /> <br />operated the Railroad Museum. <br /> <br />-4- <br /> <br />Draft 6 <br />
