';<''''' , C i' ' <br />ur\UI' <br /> <br /> <br />'f <br /> <br />2009-04 <br /> <br />'<r"_""""","~4~',,,,,,,_ <br /> <br />AN ORDINANCE TO ENACT A NEW SECTION, NUMBER 22-567.2, OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO THE <br />PARKING OF UNCONNECTED SEMITRAILERS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />That the Code of the City of Portsmouth, Virginia (2006) be, and hereby is, amended and <br />reordained by enacting a new section, Section 22-567.2, as follows: <br /> <br />Section 22-567.2 - Parking of Unconnected Semitrailers. <br /> <br />(a) The term "semitrailer" shall be deemed to mean every vehicle of the trailer type so designed <br />and used in conjunction with a motor vehicle that some part of its own weight and that of its own <br />load rests on or is carried by another vehicle. This section shall apply only to semitrailers that are <br />at least twenty-three feet in length, whether loaded or unloaded. <br /> <br />(b) No person shall park a semitrailer that is not connected to a truck or tractor, on any public <br />street, sidewalk, or right-of-way at any time. <br /> <br />(c) (l)Any police officer of the city who observes a semitrailer parked in violation of the <br />preceding subsection shall make reasonable efforts to contact the owner and seek to have <br />the owner remove the trailer before taking any official action. If these efforts are not <br />successful, the police officer may then cause it to be ticketed, towed, and impounded. <br /> <br />(2) However, ifthe trailer creates a traffic hazard, there shall be no requirement of effort <br />to contact the owner, and the trailer may be ticketed, towed, and impounded forthwith. <br /> <br />(d) The fine for a violation of this section shall be $250. <br /> <br />(e) A semitrailer that has been impounded under this section shall not be released until the owner <br />thereof, or a person acting on behalf of the owner, pays in full the towing charge, all accrued <br />impound fees, and the fine. <br /> <br />This ordinance shall take effect on the date of its adoption. <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on January <br />13,2009. <br /> <br />Teste: <br /> <br />City Clerk <br />
