<br />7. That Section 32-7(d) of the Code of the City of Portsmouth, Virginia (2006) be <br />amended and reordained to read as follow: <br /> <br />Sec. 32-7. Street encroachments generally. <br /> <br />(d) Exceptions. For purposes of this section, a sign placed on the sidewalk portion of the public <br />right-of-way adjoining property in the T4, TS, and T6 subdistricts of the downtown D-l zoning <br />district shall not be deemed an encroachment, provided that: <br />(1) The sign is not permanently affixed to the sidewalk. <br />(2) No part of the sign exceeds 42 inches in height. <br />(3) No sign face exceeds eight square feet. <br />(4) The sign is not illuminated. <br />(5) The sign is of an "A" or "T" frame design. <br />(6) The sign is located immediately in front of the business or activity advertised. <br />(7) Only one sign per building street frontage is placed on the subject right-of-way. <br /> <br />8. That Table 36.1 of the Code of the City of Portsmouth, Virginia (2006), entitled <br />"Canopy Cover Requirements" be amended by amending the Zoning District category "D-l, <br />Downtown (all subdistricts)" to read "Downtown D-l: T4, T5, T6, and SD subdistricts," and by <br />amending the Zoning District category "D-2, Downtown (all subdistricts)" to read "Downtown <br />D-2 subdistricts and Downtown D-1 T3 subdistrict." <br /> <br />9. That the Zoning Map is hereby amended to define the boundaries of the <br />Downtown D-l zoning district and of the T2, T3, T4, T5, T6, and SD subdistricts thereof as set <br />out in Exhibit B, attached hereto and made a part hereof. <br /> <br />10. That this ordinance shall take effect on January 1,2010. <br /> <br />ADOPTED by the Council ofthe City of Portsmouth, Virginia at a meeting held on <br />November 24,2009. <br /> <br />Teste: <br /> <br />City Clerk <br />
