<br />ORDINANCE TO CLOSE WILSON PARKWAY AND PORTIONS OF UNNAMED
<br />LANE LYING ADJACENT TO FREDERICK BOULEVARD, GIBNEY STREET, OAST
<br />STREET, COLUMBIA STREET, REESE STREET, SMITH STREET, THOMAS
<br />STREET, SYER STREET, FORD STREET, 24TH STREET, WILLIAMS STREET IN
<br />THE JEFFREY WILSON/STEPHEN H. CLARKE ACADEMY AREA.
<br />
<br />WHEREAS, the School Board of the City of Portsmouth, Virginia and Portsmouth
<br />Redevelopment Housing Authority have requested the closure of Wilson Parkway and portions
<br />of an unnamed lane lying adjacent to Frederick Boulevard, Gibney Street, Oast Street, Columbia
<br />Street, Reese Street, Smith Street, Thomas Street, Syer Street, Ford Street, 24th Street, Williams
<br />Street in the Jeffrey Wilson/Stephen H. Clarke Academy area, as hereinafter described; and
<br />
<br />WHEREAS, the Planning Commission, at a meeting held on January 6, 2009
<br />recommended approval of the closure and vacation of portions of Wilson Parkway and portions
<br />of an unnamed lane lying adjacent to Frederick Boulevard, Gibney Street, Oast Street, Columbia
<br />Street, Reese Street, Smith Street, Thomas Street, Syer Street, Ford Street 24th Street, Williams
<br />Street in the Jeffrey Wilson/Stephen H. Clarke Academy area, as hereafter described; and
<br />
<br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining
<br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended
<br />
<br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth,
<br />Virginia that Wilson Parkway and portions of an unnamed lane lying adjacent to Frederick
<br />Boulevard, Gibney Street, Oast Street, Columbia Street, Reese Street, Smith Street, Thomas
<br />Street, Syer Street, Ford Street, 24th Street, Williams Street in the Jeffrey Wilson/Stephen H.
<br />Clarke Academy area, be closed and vacated as a public street and right of way all shown on the
<br />attached exhibit entitled: "Exhibit A" Streets To Be Closed On Jeffrey Wilson-Hope VI &
<br />Stephen H. Clarke Academy, Portsmouth, Virginia" dated December 18, 2008 made by Horton
<br />& Dodd, P.C., Surveyors, Engineers & Planners, a copy of which said Exhibit is attached hereto
<br />and made a part hereof;

<br />BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an
<br />easement in the portion of Wilson Parkway hereby closed and vacated for the installation,
<br />operation, maintenance and replacement of public utilities which said easements may be released
<br />and vacated by the City Manager of the City of Portsmouth as he may in his discretion deem
<br />appropriate and in the best interest of the City of Portsmouth.

<br />BE IT FURTHER ORDAINED that the City Manager is hereby authorized to execute
<br />such deeds or other documents as he may deem appropriate and necessary to convey such rights
<br />as the City may have in said closed streets as may be required by the adjoining property owners.
<br />
<br />Adopted by the Council of the City of Portsmouth, Virginia at a meeting held on
<br />FebruarylO, 2009.
