The alignment and design of the road are optimized, <br />consistent with other applicable requirements, to minimize <br />encroachments in the RP A and adverse effects to water <br />quality; <br /> <br />3. The design and construction of the road or driveway <br />satisfy all applicable criteria of this chapter; including the <br />submission of a water quality impact assessment; and <br /> <br />4. The proposal is reviewed in coordination with the site <br />plan, subdivision and plan of development review <br />processes. <br /> <br />f. It is a flood control or storm water facility that drains or treats <br />water from multiple development projects or from a significant <br />portion of a watershed, which meets the following: <br /> <br />1. The location of the facility has been found to be the <br />optimum location by the city; <br /> <br />2. The size of the facility is the minimum necessary to <br />provide the necessary flood control, stormwater treatment <br />or both; <br /> <br />3. The facility is consistent with chapter 31.1 (stormwater <br />management) and has been approved as a Phase I <br />modification of the city's Chesapeake Bay Program; <br /> <br />4. All applicable permits for work in and around state and <br />federal waters have been obtained and received prior to <br />construction; <br /> <br />5. Approval must be received from the city prIor to <br />construction; and <br /> <br />6. Routine maintenance may be performed on such <br />facilities to assure that they continue to function as <br />designed. <br /> <br />(2) Exemptions in RP As. The following land disturbances III the resource <br />protection area may be considered exempt: <br /> <br />a. Water wells; <br /> <br />b. Passive recreational facilities such as boardwalks, trails and pathways; <br />and <br />
