<br />- .. <br /> <br />.. <br /> <br />with all erosion and sediment control requirements and the performance standards for <br />redevelopment in Section 9.1-10. <br /> <br />(e) If at least 25 percent of a lot, parcel, or development project lies within the <br />boundaries of a CBP A, the entire lot, parcel, or development project shall comply with <br />the requirements of this chapter. <br /> <br />Sec. 9.1-7. Required conditions. <br /> <br />(a) All development and redevelopment exceeding 2,500 square feet of land <br />disturbance shall be subject to a plan of development process, including the approval of a <br />site plan in accordance with the provisions of the zoning ordinance set out in chapter 40 <br />or a subdivision plat in accordance with chapter 33. <br /> <br />(b) The city may allow development in RP As upon approval only if it: <br /> <br />(1) Is water-dependent as listed in Sec. 9.1-10(c); or <br /> <br />(2) Constitutes redevelopment as listed in Sec. 9.1-10(c) <br /> <br />(c) A water quality impact assessment shall be required for any proposed land <br />disturbance within RP As and for any development within RMAs when required by the <br />city engineer because of the unique characteristics of the site or intensity of development, <br />in accordance with the provisions of Section 9.1-11 (6). <br /> <br />Sec. 9.1-9. Interpretation of resource protection area boundaries. <br /> <br />(a) Delineation by the applicant. The site-specific boundaries of the RP A shall <br />be determined by the applicant through the performance of an environmental site <br />assessment, subject to approval by the director of planning and in accordance with <br />section 9.1-11 (2). A site-specific evaluation shall be conducted to determine whether <br />water bodies on or adjacent to the development site q.ave perennial flow. The Chesapeake <br />Bay Preservation Area Map shall be used as a guide to the general location of RP As. <br /> <br />(b) Where conflict arises over delineation. Where the applicant has provided a <br />site-specific delineation of the RP A, the director of planning will verify the accuracy of <br />the boundary delineation. In determining the site-specific RP A boundary, the director of <br />planning may render adjustments to the applicant's boundary delineation, in accordance <br />with section 9.1-11. In the event the adjusted boundary delineation is contested by the <br />applicant, the applicant may seek relief in accordance with the provisions of section 9.1- <br />II (9). <br /> <br />(c) Final delineation shown on CBP A map. When a delineation of a CBP A has <br />been approved or established by the director of planning, the CBP A Map shall be <br />amended to reflect that delineation. <br />
