<br /> <br />2009-07 <br /> <br />!ii..~"....","_..._~.~,~,,",_'" <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY ADOPTING A NEW SECTION 40-48.3 <br />THEREOF TO ESTABLISH A MIDTOWN RESIDENTIAL OPPORTUNITY <br />ZONING OVERLAY DISTRICT. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia (2006) be amended by <br />the adoption of a new Section 40-48.3 to read as follows: <br /> <br />Sec. 40-48.3. Midtown Residential Opportunity District. <br /> <br />(a) There is hereby created within the City a zoning overlay district to be <br />known as the Midtown Residential Opportunity District, designated RO-2, the boundaries <br />of which are set forth on a map maintained in accordance with sections 40-42.1 and 40- <br />48. <br /> <br />(b) Within the RO-2 district, the planning commission may, by special <br />exception, modify the physical development standards applicable to an RM-60 zoning <br />district, in the areas and to the extent permitted below: <br /> <br />TABLE INSET: <br /> <br />RM-60 <br /> <br />Lot Size <br />Lot Size Townhouse <br />Lot Width <br />Minimum Lot area per unit <br />Maximum building Coverage <br /> <br />6,000 sq. ft. <br />20 units per acre <br />60 ft. <br />1,750 sq. ft. <br />35% <br /> <br />Building Height <br /> <br />45 ft. <br /> <br />Front Yard Setback <br />Rear Yard Setback <br />Side Yard Setback <br />Corner Side Yard Setback <br />Parking <br /> <br />25 ft. <br />25 ft. <br />As applicable <br />20 ft. <br />Two spaces per unit <br /> <br />% of Exception Permitted <br /> <br />80% reduction in lot size <br />30% increase in lot size <br />80% reduction lot width <br />75% decrease in lot size <br />175% increase in lot <br />coverage <br />50% increase in building <br />height <br />80% reduction <br />80% reduction <br />90% reduction <br />75% reduction <br />1.5 spaces per unit.
