<br />. .,.'N a'c E NO 2008-08 <br />,)iili~i~A ._____._. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY ADOPTING NEW SECTION 40-46.3 TO <br />CREATE A PARKING OVERLAY DISTRICT IN THE MIDTOWN AREA OF <br />THE CITY. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Chapter 40 of the Code of the City of Portsmouth, Virginia (2006) is <br />amended by adopting new Section 40-46.3 to read as follows: <br /> <br />Sec. 40-46.3. Midtown Parking Overlay District. <br /> <br />(a) There is hereby created within the City a parking overlay district, <br />designated POD-I, to be known as the Midtown Parking Overlay District. The <br />boundaries of said district are as set forth on a map established at the time of the adoption <br />of this section and shall be maintained in the Office of Planning in accordance with <br />section 40-42.1. <br /> <br />(b) Within the POD-l district, the following parking standards shall apply: <br /> <br />11 Retail: Four parking spaces per 1,000 square feet of gross sales <br />floor area and one parking space per 1,000 square feet of gross <br />merchandise storage floor area. For retail spaces where storage is <br />not specified, 12% of the total floor area will be deemed storage <br />for the purpose of calculating parking. <br />111 Restaurants: Seven parking spaces per 1,000 square feet of gross <br />floor area. <br />IV Eating Establishments: 4.5 parking spaces per 1,000 square feet of <br />gross floor area used for customer seating and one parking space <br />per 1,000 square feet of gross floor area used for kitchen, storage, <br />or ancillary purposes. Parking stacking for drive thru operations <br />shall accommodate a minimum of five cars. <br />v Office and Retail Bank Branch Establishments: Four parking <br />spaces per 1,000 square feet of gross floor area. <br />VI Entertainment Establishments: Ten spaces per 1,000 square feet of <br />gross floor area. <br />Vll Service establishments: Two spaces per 1,000 square feet of gross <br />floor area. <br /> <br />2. That the boundaries of the Midtown Parking Overlay District (POD-I) <br />shall be as set forth in Exhibit A, attached hereto and made a part hereof. A copy of said <br />Exhibit A shall be maintained in the Office of Planning in accordance with the provisions <br />of Section 40-42.1 of the Code of the City of Portsmouth, Virginia (2006). <br />
