<br />clauses (a) through (i) of this Section 4.1. If the Grantee notifies City that it is <br />unwilling to accept this additional service availability requirement, City may, <br />after notice and public hearing, tenninate this Franchise. <br /> <br />4.1.4 The Grantee shall file a certificate at its third and seventh, and if <br />applicable, tenth, anniversary dates certifying its compliance with the foregoing <br />service requirements. <br /> <br />4.2 Reserved <br /> <br />4.3 Programming. The Grantee shall offer to all Customers a diversity of <br />Video Programming services. <br /> <br />4.4 Educational and Governmental Access Channels. Grantee shall continue <br />to provide the City, or its designee, with access to a minimum of three (3) designated <br />channels for public, educational and governmental use. Grantee shall not exercise <br />editorial control over any public, educational or governmental use of the designated <br />channel capacity. <br /> <br />4.4.1. Public Access. A "Public Access Channel" is a channel designated <br />for noncommercial use by any Person so long as such Person complies with the <br />rules established by the City, or its designee. <br /> <br />4.4.2. Educational Access. An "Educational Access Channel" is a <br />channel designated for noncommercial use by educational institutions such as <br />public or private schools (but not "home schools"), community colleges, and <br />universities. <br /> <br />4.4.3. Government Access. A "Governmental Access Channel" is a <br />channel designated for noncommercial use by the City for the purpose of showing <br />the public local government at work. <br /> <br />4.4.4. PEG Capital Grant Surcharge Fee. Grantee shall provide a PEG <br />Capital Grant Surcharge Fee in the amount of one and one half percent (1.5%) of <br />Grantee's Gross Revenues. <br /> <br />4.4.5. Grantee shall provide a television programming transmission link <br />from the City Hall, or such other location as the City may later designate to the <br />Cable System headend with all necessary transmission and tenninal equipment. If <br />the City requests relocation from the original transmission site, the cost of such <br />relocation shall be borne by the City. At the head end, the transmission link shall <br />interface with the Cable System downstream access channel modulator and other <br />equipment as needed, if any. <br /> <br />4.5 No Discrimination.
