")'D INANCE liD 2008-76 <br />Ut\' n" "_.......,.).,,,,.,_,, <br /> <br />ZONING AMENDMENT ORDINANCE Z-08-07 <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Downtown Residential D-I-R the <br />property described in Petition for Zoning Amendment Number Z-08-07, is hereby <br />amended and changed so as to show said property zoned as Downtown Mixed Use D-l- <br />M-K (Conditional), and that said property is hereby zoned as Downtown Mixed Use D-1- <br />M-K (Conditional), <br /> <br />2. That the property affected by this ordinance by being zoned from <br />Downtown Residential D-1-R to Downtown Mixed Use D-I-M-K (Conditional) is <br />furthermore described as follows: <br /> <br />Z-08-07 <br /> <br />610 Green Street/700 County Street <br /> <br />The parcel described as beginning at a pin located at the <br />northwestern intersection of County Street and Green <br />Street; thence proceeding N 135 feet more or less to a <br />point; thence W 49.50 feet more or less to a point; thence S <br />25 feet more or less to a point; thence E 18.50 feet more or <br />less to a point; thence S 109.3 5 feet more or less to a point; <br />thence E 29 feet more or less to the point of beginning. The <br />property is further described as Map 25, Parcel 31. <br /> <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br />(a) The applicant and all successors in interest are restricted from engaging in <br />the following activities: <br />Parking of construction equipment <br />Manufacturing <br />Railroad transportation <br />Transit operations <br />Bus terminal operations <br />Heliport <br />Communications tower <br />Wastewater treatment <br />Automotive repair services <br />Miscellaneous repair services <br />(b) The property owner will remove the excess cable lines in the front of the <br />building to the extent possible, and Dominion Power will replace poles. <br />
