<br />Beginning at a point 79'7: from the southwest comer of <br />High and Dinwiddie Streets; thence in a westerly direction <br />21' 7: to a point; thence, in a southerly direction 113.1'7: to <br />a point; thence in an easterly direction 21'7: to a point; <br />thence, in a northerly direction 113.1'7: to a point of the <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) This establishment shall be limited to a capacity of 150 persons, including <br />employees, or the capacity set by the Fire Marshall. The more restrictive <br />of the two capacity limitations shall apply. The occupancy load shall not <br />be exceeded at any time. <br /> <br />(b) Days and hours of operation shall be daily no earlier than 7:00 a.m. to no <br />later than 2:00 a.m. <br /> <br />(c) Entertainment shall be limited to the hours between 5:00 p.m. and 2:00 <br />a.m. <br /> <br />(d) Noise from the entertainment establishment shall not be audible at the <br />property line. <br /> <br />(e) The facility shall be limited to the use of one D.l or to a band having no <br />more than five members per day. <br /> <br />(f) Sufficient interior security shall be provided by individuals who are <br />certified in law enforcement by the Virginia Department of Criminal <br />Justice Services. Exterior security shall be provided, as needed, by off- <br />duty law enforcement personnel. <br /> <br />(g) The dance floor may not exceed an area of 150 square feet in size. <br /> <br />(h) The applicant shall obtain approval from the Downtown Design <br />Committee (DDC) for any exterior alterations, including signage. <br /> <br />(i) The applicant shall comply with the trash plan approved by General <br />Services dated October 2007. <br /> <br />(j) The owner/developer shall be responsible for upgrades to water and sewer, <br />as necessary, including the installation of a backflow preventer device <br />approved by the Public Utilities Department. <br /> <br />(k) The proposed business shall operate in accordance with federal, state and <br />local regulations, including the Uniform Statewide Building Code. <br />
