That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) This establishment shall be limited to a capacity of 150 persons, including employees, or the capacity set by the Fire Marshall. The more restrictive of the two capacity limitations shall apply. The occupancy load shall not be exceeded at any time. (b) Days and hours of operation shall be daily no earlier than 7:00 a.m. to no later than 2:00 a.m. (c) Entertainment shall be limited to the hours between 5:00 p.m. and 2:00 a.m. (d) Noise from the entertainment establishment shall not be audible at the property line. (e) The facility shall be limited to the use of one D.l or to a band having no more than five members per day. (f) Sufficient interior security shall be provided by individuals who are certified in law enforcement by the Virginia Department of Criminal Justice Services. Exterior security shall be provided, as needed, by off- duty law enforcement personnel. (g) The dance floor may not exceed an area of 150 square feet in size. (h) The applicant shall obtain approval from the Downtown Design Committee (DDC) for any exterior alterations, including signage. (i) The applicant shall comply with the trash plan approved by General Services dated October 2007. (j) The owner/developer shall be responsible for upgrades to water and sewer, as necessary, including the installation of a backflow preventer device approved by the Public Utilities Department. (k) The proposed business shall operate in accordance with federal, state and local regulations, including the Uniform Statewide Building Code.
