<br />;> <br /> <br />R-08-07 <br /> <br />A RESOLUTION GRANTING CONDITIONAL APPROVAL FOR SOUTHERN <br />MEDICAL TRANSPORTATION SERVICES, INC., A PRIVATE EMERGENCY <br />MEDICAL SERVICES AGENCY, TO PROVIDE CERTAIN TRANSPORT <br />SERVICES WITHIN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, Virginia Code gI5.2-955 provides that no organization shall <br />provide emergency medical services without the prior approval by resolution of the local <br />governing body; and Virginia Administrative Code regulation 12V AC5-31-420 also <br />requires that any applicant for licensure by the Virginia Office of Emergency Medical <br />Services include such local approval in its state license application; and <br /> <br />WHEREAS, Southern Medical Transportation Services, Inc., a private business <br />(herein "Southern"), desires a state license to provide certain medical transport services <br />in the City of Portsmouth, Virginia; and <br /> <br />WHEREAS, the Chief of the Portsmouth Department of Fire, Rescue and <br />Emergency Services (the "Fire Chief') has determined that Southern has appropriate <br />trained staff and equipment to properly provide said services; now therefore <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. Said local government approval is hereby granted to Southern, with the <br />following mandatory requirements while operating within the City of Portsmouth: <br /> <br />a. Southern shall limit its transport services to non-emergency transports. <br /> <br />b. Southern may not attempt to provide service to, nor shall it respond to, <br />emergency situations (commonly known as "911 Calls") unless requested by an <br />authorized official of the Portsmouth Department of Fire, Rescue, and Emergency <br />Services (the "Department"), or through a written agreement with the Department. <br /> <br />c. If Southern learns of an emergency situation while engaged in the normal <br />course of business, it shall promptly report same to the Dispatch Center operated <br />by the Department, and it shall thereafter follow all directives of the Department. <br /> <br />d. By accepting this approval, Southern acknowledges and agrees that the <br />Department is the only designated 911 agency authorized to provide emergency <br />services and emergency transport. <br /> <br />e. Southern shall timely pay all federal, state, and local taxes, shall obey all <br />applicable federal, state, and local laws and regulations, and shall keep all its <br />transport vehicles and medical equipment in a safe, neat, clean, well-maintained, <br />and sanitary condition. <br />
