That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The occupant load of the first floor shall remain at no greater than 150 people. The total occupant load of the second, third and fourth floors shall be limited to no more than 949 people, including employees, or the capacity set by the Building Official. The more restrictive of the two capacity limitations shall apply. The occupancy load shall not be exceeded at any time. (b) The occupant loads of the second and third floors shall not exceed 450 people per floor, including employees, and the fourth floor shall not exceed 49 people, including employees, or the capacity set by the Building Official. (c) The hours of operation shall be limited to the hours between 8:00 a.m. and 2:00 a.m. (d) Hours of entertainment shall be limited to the hours between 11 :00 a.m. and 2:00 a.m. . (e) All food, drinks, and alcohol on any floor must be provided by the owner of the restaurant on the first floor. No outside catering of any kind shall be allowed. (f) Sufficient interior security shall be provided by individuals who are certified in law enforcement by the Virginia Department of Criminal Justice Services. Exterior security shall be provided, as needed, by off- duty law enforcement personnel. (g) The site layout plan shall generally be in accordance with the floor plans dated June 25, 2008. Minor changes may be approved by the Director of Planning. (h) The applicant shall obtain approval from the Downtown Design Committee (DDC) for any exterior alterations, including signage.
