ORDINANCE HO.~~ 7: 11 ~ ORDINANCE TO CLOSE PORTIONS OF JOHNSON AVENUE NORTH, BYERS AVENUE, SYKES AVENUE AND UNNAMED STREET. WHEREAS, the School Board of the City of Portsmouth, Virginia has requested the closure of portions of Johnson A venue North, Byers A venue, Sykes A venue and an unnamed street, as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on November 6, 2007 recommended approval of the closure and vacation of portions of Johnson Avenue North, Byers Avenue, Sykes Avenue and an unnamed street; and WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that a portion of Johnson Avenue North, Byers A venue, Sykes A venue and an unnamed street be closed and vacated as a public street and right of way in the City of Portsmouth, Virginia, as follows: All portions of streets shown on the Plat of Simonsdale, Section No.5 which said plat is duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake in Map Book 25, at page 10, as follows: (1) All of that portion of Johnson Avenue North as shown on said plat from its point of intersection with the western line of Lot 561 as shown on said plat if said line were extended across Johnson Avenue North to the point of intersection with the western line of Lot 509 and Johnson Avenue North, as shown on the aforementioned plat and from thence in a northeasterly direction to the point where said street merges into and becomes Byers Avenue. (2) All that portion of Byers Avenue from its point of intersection with the right of way line of Johnson Avenue eastwardly to the point where said Byers Avenue merges into and becomes Johnson Avenue North. (3) All that portion of Sykes A venue from its point of intersection with Johnson A venue to its point of intersection with the northwesterly line of Byers A venue. (4) All that unnamed street bounded on the south by Johnson Avenue, on the west by a parcel marked "reserved" on said plat, on the north by the right of way of Johnson Avenue North and on the East by Lot 561. BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an easement in the portion of Scott Street hereby closed and vacated for the installation, operation, maintenance and replacement of public utilities of the City of Portsmouth, Virginia, which said easements may be released and vacated by the City
