Recyclable materials, which are those materials that have been source-separated by <br />any person or materials separated from solid waste by any person for utilization in both <br />cases as a raw material to be manufactured into a product other than fuel or energy. <br />3. This section shall not prevent or prohibit disposal of solid waste at any facility which <br />was issued a solid waste management facility permit by an agency of the Commonwealth on or <br />before July 1, 1991, or for which a Part A permit application for a new solid waste management <br />facility permit, including local governing body certification, was submitted to the Virginia <br />Department of Environmental Quality in accordance with Section 10.1-1408.1 B of the Code of <br />Virginia on or before December 31, 1991. <br /> <br />Section 16-169. Other disposal sites prohibited; revocation of permit. <br /> <br />No person may dispose of solid waste generated or collected within the City at any place <br />other than those designated pursuant to Section 16-168. The Director of Public Works or his <br />designee following a hearing may revoke a permit to operate a private solid waste collection <br />business obtained under Section 16-167 for failure to comply with this section. <br /> <br />Section 16-170. Operating without a permit unlawful. <br /> <br />Operating a private solid waste collection business without a permit as required herein <br />shall be a Class 3 Misdemeanor. Upon conviction hereunder, punishable by a fine of not more <br />than $500, or such fine as may be fixed by Va. Code ~ 18.2-11 or any successor statute. Each <br />day in violation shall constitute a separate offense. <br /> <br />Section 16-171. Injunctive relief. <br /> <br />In addition to the other remedies and penalties imposed under this Article, the City shall <br />have the power to seek injunctive relief from a court of competent jurisdiction to enjoin <br />continuing or future violations of Section 16-169 and/or 16-170, without any requirement of <br />showing irreparable harm. <br /> <br />2008. <br /> <br />3. Effective date. This ordinance/resolution shall be effective on and after January 1, <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />November 27, 2007. <br /> <br />Teste: <br /> <br />City Clerk <br />
