<br />Sec. 40-54.1. Historic districts, properties; publicly-owned property. <br /> <br />The city manager or other appropriate city official shall file an application for a <br />certificate of appropriateness for the proposed construction, alteration, renovation, or <br />razing of any historic city-owned building or structure, and shall adhere to all other <br />requirements of this division. For buildings and structures owned by other governmental <br />entities or public utilities companies, the city manager or other appropriate city official <br />shall request that such owners submit an application for a certificate of <br />appropriateness and adhere to all requirements of this division. <br /> <br />Nothing in this article or section shall be construed to prevent the construction, <br />reconstruction, alteration, or demolition of any such elements that the authorized city <br />officers certify as required for public safety <br /> <br />Sec. 40-54.2. Certificate of appropriateness; administrative review and approval. <br /> <br />Administrative review of an application for a certificate of appropriateness is <br />permitted in accordance with the following provisions: <br /> <br />(a) The designated staff of the historic preservation commission may issue a <br />certificate of appropriateness if authorized by standards and guidelines approved by the <br />city council. <br /> <br />(b) The commission's designated staff shall be guided by the standards and <br />guidelines established for the commission and shall have the authority to request of the <br />applicant modifications of a specific proposal in order that such proposal may comply <br />with said standards and guidelines. <br /> <br />(c) In any case where the designated staff is uncertain of hislher authority to <br />act on a particular application, or in any case where the designated staff and the applicant <br />cannot agree on changes in the proposal, or if the designated staff otherwise fails to issue <br />such certificate within 30 days, the application shall be referred to the commission for <br />action. A written report/agenda shall accompany any application forwarded to the <br />commISSIOn. <br /> <br />(d) The designated staff shall report, in writing, to the historic preservation <br />commission at each regular meeting on all certificates so issued. <br /> <br />(e) Not withstanding the above, the building official, the zoning administrator, <br />or their designees may order that work be stopped and that an appropriate application be <br />filed for commission review upon determination that the action being undertaken <br />surpasses ordinary maintenance as defined in Section 40-55, a certificate of <br />appropriateness is not displayed, or the work being performed is not in conformance with <br />the approved action for which a certificate of appropriateness has been issued. <br />
