<br />R-07-35 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />DEED OF RELEASE FOR A 20 FOOT PUBLIC UTILITY EASEMENT OVER, <br />UNDER AND ACROSS THE OLD LOWE'S SITE NORTH OF WESTERN <br />BRANCH BOULEVARD IN THE CHURCHLAND AREA. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth that the City <br />Manager be, and he hereby is, authorized to execute a Deed of Release and any other <br />documents as may be required to the owner(s) of Parcel AlAI as shown on that certain <br />plat entitled: "RE-SUBDIVISION OF PARCEL AlA OF RESUBDIVISION PLAT OF <br />PARCELS AI & A2 (M.B. 146, P.53) & UNNAMED PARCEL AS SHOWN ON PLAT <br />LAUREL PARK (D.B. 614, P. 267) dated March 24, 2006 and duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 21, <br />Page 89, and designated as "EX. 20' UTILITIES ESM'T TO BE ABANDONED (M.B. <br />77, P. 98-98C)", releasing to such owner(s) all right, title and interest, ifany, which the <br />City of Portsmouth has, or may have, in and to said easement for construction, <br />maintenance, operation and replacement of public utility lines 20 feet in width from the <br />City boundary line between the City of Chesapeake and the City of Portsmouth <br />northwardly to a point 20 feet south of the northern boundary of said parcel as shown on <br />the aforementioned plat. <br /> <br />ADOPTED at a meeting of the Council of the City of Portsmouth, Virginia held <br />on July 10,2007. <br /> <br />Teste: <br /> <br />City Clerk <br />
