<br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load shall be limited to 102 people, including employees. <br />An employee shall be employed to monitor the entrance to the <br />establislunent and shall keep an accurate count of the number of patrons. <br /> <br />(b) No line of waiting patrons shall be allowed to form outside the building, <br />nor shall loitering in the parking lot be allowed. <br /> <br />(c) The hours of operation shall be limited to the hours between II :00 a.m. <br />and 2:00 a.m. nightly. <br /> <br />(d) The site layout plan shall generally be in accordance with the site plan <br />dated April 20, 2007. <br /> <br />(e) A full menu of food shall be offered from Monday through Sunday until <br />10:30 p.m. <br /> <br />(1) Noise may not be audible to adjacent residents or businesses, or at any <br />adjacent or surrounding property lines. <br /> <br />(g) The applicant shall utilize commercial garbage collection that employs an <br />inside container, which has been approved by General Services. <br /> <br />(h) The establislunent shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments. <br /> <br />(i) The applicant shall obtain all required licenses and permits before <br />operation and these licenses and permits shall remain in effect during the <br />operation of the establislunent. <br /> <br />OJ Taxes and fees associated with the property shall be paid when due. <br /> <br />(k) The owners and/or operators of the restaurant shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good <br />order, nor suffer repeated or chronic violations by any of its patrons or <br />customers. <br /> <br />If the Chief of Police, in his discretion, determines that there are sufficient <br />violations of this type to comprise a significant law enforcement problem, <br />he shall so notify the applicant in writing and shall provide a copy of such <br />notice to the Director of Planning and Zoning. <br /> <br />If, within six (6) months of the date of such letter, the Director of Planning <br />and Zoning determines that the offenses against peace and good order are <br />
