<br />2. The City of Portsmouth hereby finds and determines that use of the Property as a <br />public park providing public, non-commercial waterfront access is a public use and an authorized <br />public undertaking. <br /> <br />3. The City Attorney is authorized and directed to take all actions set forth by law <br />and reasonably implied by law to acquire the Property from the current owners, John T. Johnson <br />and Rhonda R. Johnson, husband and wife, and Park View Home Company, or said owners' <br />successors or assigns. The Portsmouth Redevelopment and Housing Authority is requested to <br />provide staff assistance to the City Attorney for this acquisition. <br /> <br />4. Agents and officials ofthe City of Portsmouth are authorized to enter onto the <br />property for the purpose of inspection, pursuant to Virginia Code 925. I -203 and other applicable <br />laws. <br /> <br />5. The use of the power of eminent domain to acquire the Property is hereby <br />authorized, as per Portsmouth City Charter 992.06, 2.07, and 2.08 and Virginia Code, Titles 15.2 <br />and 25.1, plus all other applicable law and authorization, without further official vote, action, or <br />authorization by Portsmouth City Council. <br /> <br />6.
