That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The project shall comply with thc approved plan entitled Proposed <br />Restaurant 702 High Street. <br /> <br />(b) The project shall comply with the proposal for the exterior remodeling <br />approved by the Downtown Design Committee October 3, 2006. <br /> <br />(c) Days and hours of operation shall be limited to Monday through Friday, <br />10:30 a.m. to I :30 a.m. and to Saturday and Sunday, 7:30 a.m. to 1:30 <br />a.m. <br /> <br />(d) The restaurant shall not accommodate more than 75 persons. The Fire <br />Marshal shall establish final capacity. <br /> <br />(e) The applicant shall obtain and maintain in effect all appropriate permits <br />and licenses for the establishment. <br /> <br />(f) The proposed business shall operate in accordance with federal, state and <br />local codes and regulations. <br /> <br />(g) Trash shall be removed by either City trash pickup or a commercial waste <br />hauler. <br /> <br />(h) All taxes and fees in connection with the proposed use shall be paid when <br />due. <br /> <br />4.
