<br />UP-07-02 <br /> <br />That parcel beginning at a property pin located <br />approximately 35 feet west of the centerline of the existing <br />pavement of Tyre Neck Road; said pin located at the <br />southeast corner of property presently belonging to the <br />Churchland Swim and Racquet Club. Thence, proceeding <br />S 85044'10"E 550.02 feet plus or minus, to a point, thence <br />S06034'50"W 179.61 feet more or less to a point, thence, <br />proceeding S85044' 10"E 550.02 feet more or less to a point <br />thence, S06035' l3"W 179.61 feet more or less to the point <br />of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Prior to obtaining construction permits, a certified report from a qualified <br />and licensed professional engineer must be submitted to the Director of <br />Planning demonstrating that: <br /> <br />a. The proposed tower will meet the structural requirements of the <br />statewide building code and the requirements of, E1A-222E, <br />Structural Standards for Steel Antenna Towers and Antenna <br />Supporting Structures; <br />b. The non-ionizing electromagnetic radiation (NIER) that will be <br />emitted from the proposed facility, along with others on the same <br />structure or in the immediate vicinity, will not exceed exposure <br />standards of the U.S. Government; and <br />c. The tower will not cause interference with any equipment such as <br />radio, television and computers operated by users on adjacent <br />properties. <br /> <br />(b) The applicant will provide a Major Water Quality Impact Assessment, as <br />suggested by the City Engineering office and required by the Chesapeake <br />Bay Plan of Development Process, which states that any development that <br />produces a land disturbance of greater than 5,000 square feet requires such <br />a Major Assessment to be done. <br /> <br />(c) The applicant will submit an erosion and sediment control plan/site plan. <br /> <br />(d) The applicant shall obtain a Chesapeake Bay Ordinance Exception for the <br />proposed development. <br />
