<br />R-07-65 <br /> <br />A RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP- <br />07-10) TO PORTSMOUTH SB, LLC, TO CONSTRUCT FOUR RESIDENTIAL <br />CONDOMINIUM UNITS AT 361 EFFINGHAM STREET. <br /> <br />WHEREAS, Portsmouth SB, LLC, pursuant to Section 40-112 of the Code of the <br />City of Portsmouth, Virginia (2006), as amended, has made application for the granting <br />of a housing use permit (HP-07 -10) to construct four residential condominium units at <br />361 Effingham Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />HP-07-10 <br /> <br />That parcel described as beginning at a property pin <br />located at the northeast comer of the property at on <br />North Street. Thence, proceeding S 03041 '12"E, <br />113.55 feet more or less to a point thence, thence <br />proceeding S 87000'18"W 70.00 feet more or less <br />to a point, thence proceeding N 02056'10"E 113.61 <br />feet more or less to a point, thence proceeding N <br />87003' 48"W 68.50 feet more or less back to the <br />point of beginning. Property is also known as Tax <br />Map 20, Parcel 18 and 361 Effingham Street; <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed the submitted application <br />and site plan and has recommended conditional approval of said application; and <br /> <br />WHEREAS, the applicant has been informed that approval of the housing permit <br />pursuant to Section 40-116 only grants an exemption from certain requirements for <br />residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the City Subdivision Ordinance, the City Zoning Ordinance, or <br />any other applicable local, state or federal law or regulation; and <br /> <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council ofthe City of <br />Portsmouth, Virginia: <br /> <br />1.
