Southwest comer of the intersection of Marshall Avenue and Beech Street; thence South 01 degrees 22'43" West a distance of 187.84 feet to a point; thence North 40 degrees 052'10" West a distance of 74.37 feet to a point; thence North 01 degrees 22'43" East a distance of132.79 feet to a point; thence South 88 degrees 37'17" East a distance of 50.00 feet along the southern side of Marshall A venue to the point of beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) There shall be no more than eight persons needing care residing at the location at any given time. (b) The applicant shall provide an 18-foot by 18-foot concrete pad on the property for two (2) parking spaces. The pad shall not interfere with the planned handicapped ramp. (c) The applicant shall provide a six-foot fence along the rear property line. The fence shall be made of a solid material (i.e. vinyl or wood). No chain link fence shall be permitted. (d) The facility shall be operated and maintained in accordance with all required inspections by the City Fire Department, Public Health Department, and Building Official and shall include annual inspections. (e) The facility shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local governments, and all required licenses and permits shall be obtained and remain in effect during the operation of the facility. (f) Taxes and fees associated with the property shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council.
