Said property is also known as Tax Map 20, Parcel 18 and 361 Effingham Street. 3. That the use permit is approved subject to the following conditions which the applicant and any successor in interest shall observe: (a) The establishment shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local governments. (b) The applicant shall obtain all required licenses and permits before operation, and these licenses and permits shall remain in effect during the operation of the establishment. (c) The applicant shall obtain a Subdivision Permit from the City before construction can begin. (d) The applicant shall construct the development in accordance with the submitted plans dated June 21, 2007 and submitted elevations submitted June 22, 2007. The Director of Planning and Zoning may approve minor modifications. (e) The hours of operation shall be limited to the hours between 5 :00 a.m. and 2:00 a.m. every day. (f) The occupant load shall be limited to 54 people, including employees, and seating shall be limited to 49 people. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council.
