<br />(e) An address plan shall be submitted once the site plan <br />review process is complete. <br /> <br />(f) The applicant shall be responsible for the cost of <br />establishing and/or upgrading the necessary utilities. <br /> <br />(g) The developer shall maintain the existing six-foot fences <br />along the east and north property lines, as well as the four- <br />foot wooden picket fence along the southern property line <br />abutting Towne Point Road as proposed. <br /> <br />(h) The applicant shall adhere to the approved trash-handling <br />plan, which includes private trash pickup with garbage cans <br />being stored in the rear fenced patio behind each unit and <br />only bags being placed at the curb on and only on <br />collection day. <br /> <br />(i) The condominiums shall be operated in compliance with all <br />applicable codes, ordinances, and regulations of federal, <br />state, and local governments. <br /> <br />CD The applicant shall obtain all required licenses and permits <br />before operation, and these licenses and permits shall <br />remain in effect during the operation of the condominiums. <br /> <br />(k) All taxes and fees associated with the proposed project <br />shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-115 of the Code of the City of Portsmouth, Virginia (2006), the housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on July 24, 2007. <br /> <br />Teste: <br /> <br />City Clerk <br />
