<br />Road, Portsmouth, Virginia, is hereby granted to the applicant subject to the following <br />terms and conditions that shall be observed by the applicant and any successor in interest: <br /> <br />(a) Access to Lombardy Avenue shall remain clear of debris <br />and landscaping at all times to allow for emergency ingress <br />and egress. <br /> <br />(b) The project shall be developed in accordance to the proffers <br />approved with application Z-06-02. <br /> <br />(c) The applicant shall be responsible for the cost of any new <br />water and/or sanitary sewer infrastructure or any <br />improvements to such infrastructure. <br /> <br />(d) If the applicant utilizes City refuse collection services, the <br />cul-de-sacs shown on the site plan shall be revised to allow <br />for a minimum of a 70-foot turning area for the City's <br />automated garbage trucks. <br /> <br />(e) Waste Management for the development shall be In <br />compliance with all City Code requirements. <br /> <br />(f) The project shall be built in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and <br />local governments. <br /> <br />(g) All required licenses and permits shall be obtained before <br />construction and maintained as required by law. <br /> <br />(h) Taxes and fees associated with the property shall be paid <br />when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-115 of the Code ofthe City of Portsmouth, Virginia (2006), the housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br />
