<br />R-07-39 <br /> <br />A RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP- <br />07-07) TO GEE'S GROUP DEVELOPMENT CORPORATION TO CONSTRUCT <br />147 SINGLE-FAMILY AND DUPLEX-STYLE RESIDENTIAL CONDOMINIUM <br />UNITS AT THE CORNER OF RIVER POINTE PARKWAY AND WEST <br />NORFOLK ROAD. <br /> <br />WHEREAS, Gee's Group Development Corporation, pursuant to Section 40-112 <br />of the Code of the City of Portsmouth, Virginia (2006), as amended, has made <br />application for the granting ofa housing use permit (HP-07-07) to construct 147 single- <br />family and duplex style condominium units at the corner of River Pointe Parkway and <br />West Norfolk Road, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />HP-07-07 <br /> <br />All that certain lot, piece or parcel of land, with the <br />buildings and improvements thereon, lying, situate and <br />being in the City of Portsmouth, Virginia, and designated <br />as FUTURE RESERVE PARCEL 38 983,950 SQ. FT. OR <br />22.59 AC. as shown on that certain plat entitled "MAJOR <br />UBDIVISION OF THE ESTATES AT RIVER POINTE <br />AS SHOWN ON M.B. 13 PG. 140 & M.B. 15 PG. 50 <br />PORTSMOUTH, VIRGINIA", dated December 17, 2002 <br />by Woolpert LLP, which said plat is duly recorded in the <br />Clerk's Office of the Circuit Court of the City of <br />Portsmouth, Virginia in Map Book 19 at pages 111-114. <br /> <br />IT BEING the same property conveyed to Grantor herein <br />by Deed dated March 13, 2003 and recorded in Clerk's <br />Office of the Circuit Court of the City of Portsmouth, <br />Virginia, as Instrument No. 030043470 and corrected by <br />Deed of Correction dated April 24, 2003 and recorded in <br />the aforesaid Clerk's Office. <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed the submitted application <br />and site plan and has recommended conditional approval of said application; and <br /> <br />WHEREAS, the applicant has been informed that approval of the housing permit <br />pursuant to Section 40-116 only grants an exemption from certain requirements for <br />residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the City Subdivision Ordinance, the City Zoning Ordinance, or <br />any other applicable local, state or federal law or regulation; and <br />
