<br />(g) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia; <br />and <br /> <br />(h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans <br />with Disabilities Act <br /> <br />2, That a group housing use permit for the construction of 57 residential <br />apartment units on the property bounded by Armstrong Street, County Street, Twine <br />Avenue, and King Street, Portsmouth, Virginia is hereby granted to the applicant subject <br />to the following terms and conditions that shall be observed by the applicant and any <br />successor in interest: <br /> <br />(a) The buildings shall be built in general compliance with the <br />elevations received as part of this application, <br /> <br />(b) The building materials used shall be clapboard (Hardie <br />plank) and brick skirting, <br /> <br />(c) The finished project shall be generally consistent In <br />appearance with the adjacent Westbury neighborhood, <br /> <br />(d) The three buildings located within "Site C" of the <br />Preliminary Site Plan shall not be built until all existing <br />utility lines are abandoned and easements have been <br />vacated, <br /> <br />(e) The project shall contain no more than 57 units, <br /> <br />(f) The applicant shall be responsible for the cost of any new <br />water and/or sanitary sewer infrastructure or any <br />improvements to such infrastructure, <br /> <br />(g) The project shall be built in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and <br />local governments, <br /> <br />(h) All required licenses and permits shall be obtained before <br />construction and maintained as required by law, <br /> <br />(i) All taxes and fees associated with the property and the <br />operation shall be paid when due, <br />
