R-06-26 A RESOLUTION GRANTING A USE PERMIT TO AL PRATZ BREWING COMPANY, L.L.C., TO OPERATE A BREW PUB AND RESTAURANT AT 615 HIGH STREET. WHEREAS, Al Pratz Brewing Company, LLC, has made application pursuant to S~cti(ln40-43, I of the Code of the City of Portsmouth, Virginia (1988) for the granting ofa use p~rmit to op~rate a brew pub and restaurant at 615 High Street, P0l1smouth. Virginia: and WHEREAS. the applicant and the Planning Director have done all things required to be dLln~ in connection with said application; and WHEREAS. the Planning Commission has recommended the granting of the application lor a use permit with conditions, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: I, That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; \b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sut1icient landscaping to insure compatibility with surrounding uses; (J) W ill be a project that will be developed according to a plan for parking. driveways, and curb cuts which will provide for safe and convenient trat1ic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance, 2, That Al Pratz Brewing Company, LLC, is hereby granted a use permit pursuant to Section 40-43,) of the Code of the City of Portsmouth, Virginia (1988) to operate a brew pub and restaurant at 615 High Street, and being more particularly described as: UP-06-05 Pllrcell B<::ginning at a point on the South side of High Street which said point is a distant 90 feet due West Irom the inlL'rsection of the South side of High Street with the West<::rn line of Washington Street and from said point of
